The Justice Department has designated Marc Elias, a Democratic attorney and vocal critic of the Trump administration, as a target in its criminal investigation into alleged voter confusion in Alaska. The probe is currently led by the U.S. Attorney's Office in Alaska, with additional prosecutors from the Civil Rights Division's criminal section participating in the effort. Multiple sources familiar with the matter confirmed that the investigation focuses on whether Democratic figures attempted to recruit the state's Republican incumbent, Senator Dan Sullivan, in a way that misled voters.

Elias is one of approximately 20 individuals who have received either target or preservation letters from the federal government in connection with this case. Separately, the Democratic Senatorial Campaign Committee has been served with a grand jury subpoena by law enforcement. The department has not yet specified the exact charges under which it is investigating the group.

President Trump has recently used social media to criticize Elias and urged his prosecution. In a statement, Elias noted that the timing of the legal action on Election Day was predictable given the administration's stance. He stated that his firm, the Elias Law Group, represents Democratic campaigns and progressive organizations. Elias described the investigation as a tool used against political opponents despite a lack of evidence of wrongdoing. He added that his team would continue working to support their clients and secure a victory for Democrats at the ballot box.

The investigation involves both the recruitment of Senator Sullivan and the potential impact on voters in the state. Legal experts note that target letters indicate that prosecutors possess sufficient evidence to charge an individual, while preservation letters request that records be kept intact for a future case. The U.S. Attorney's Office in Alaska has not released a public statement detailing the scope of the charges. The DSCC was contacted for comment on the subpoena but did not immediately respond.
